This work, in English "Struggle for power, organic crisis and judicial independence", has its origin in research academics of the IAEN carried out to provide expert advise to the Inter American Court of Human Rights in the case Quintana and others (Supreme Court of Justice) vs the State of Ecuador. The research is about the nature of the evolution of the ecuadorian state, the dynamics of its institutions, its players, parties, laws, its factors of instability, the way rights have been (...) deployed since the return to democracy in 1979, those who have benefited from neoliberal democracy and those who have paid the costs, and where in all this was the Supreme Court of Justice. The Introduction takes a look at this origin of the work and its intellectual import, provides a brief characterization of the Inter American Sistem of Human Rights Protection, how the Quintana Case fits within it, and an overview of the chapters and their logic. The first chapter analyzes the institutional and sociological factors that have contributed to Ecuador's historically unstable state, based primarily in an antagonistic struggle for power between the Executive and Legislative branches. The second chapter analyzes the economic and political factors that provoked an organic crisis, or crisis of hegemony, between 1997 and 2007 in Ecuador. The third chapter analyzes the evolution of the way in which judges are selected in Europe, the outcomes they have generated, and how they compare with the ecuadorian systems of judge selection in terms of securing judicial independence. The fourth chapter develops a theory of judicial independence in democracy and analyzes how Ecuador measures up to that standard, from when it became a neoliberal minimal democracy in 1981, to when it became a neoliberal false democracy as a consequence of instalation of a system evidently lacking in the people's support under the guise of the 1998 Constitution and its system of judge selection, and the new democratic horizons set by the 2008 Constitution, and the judicial system that springs from it. It is a matter of fact that Europe is facing more and more crucial challenges regarding health and social care due to the demographic change and the current economic context. The recent COVID-19 pandemic has stressed this situation even further, thus highlighting the need for taking action. Active and Assisted Living technologies come as a viable approach to help facing these challenges, thanks to the high potential they have in enabling remote care and support. Broadly speaking, AAL can be referred (...) to as the use of innovative and advanced Information and Communication Technologies to create supportive, inclusive and empowering applications and environments that enable older, impaired or frail people to live independently and stay active longer in society. AAL capitalizes on the growing pervasiveness and effectiveness of sensing and computing facilities to supply the persons in need with smart assistance, by responding to their necessities of autonomy, independence, comfort, security and safety. The application scenarios addressed by AAL are complex, due to the inherent heterogeneity of the end-user population, their living arrangements, and their physical conditions or impairment. Despite aiming at diverse goals, AAL systems should share some common characteristics. They are designed to provide support in daily life in an invisible, unobtrusive and user-friendly manner. Moreover, they are conceived to be intelligent, to be able to learn and adapt to the requirements and requests of the assisted people, and to synchronise with their specific needs. Nevertheless, to ensure the uptake of AAL in society, potential users must be willing to use AAL applications and to integrate them in their daily environments and lives. In this respect, video- and audio-based AAL applications have several advantages, in terms of unobtrusiveness and information richness. Indeed, cameras and microphones are far less obtrusive with respect to the hindrance other wearable sensors may cause to one’s activities. In addition, a single camera placed in a room can record most of the activities performed in the room, thus replacing many other non-visual sensors. Currently, video-based applications are effective in recognising and monitoring the activities, the movements, and the overall conditions of the assisted individuals as well as to assess their vital parameters. Similarly, audio sensors have the potential to become one of the most important modalities for interaction with AAL systems, as they can have a large range of sensing, do not require physical presence at a particular location and are physically intangible. Moreover, relevant information about individuals’ activities and health status can derive from processing audio signals. Nevertheless, as the other side of the coin, cameras and microphones are often perceived as the most intrusive technologies from the viewpoint of the privacy of the monitored individuals. This is due to the richness of the information these technologies convey and the intimate setting where they may be deployed. Solutions able to ensure privacy preservation by context and by design, as well as to ensure high legal and ethical standards are in high demand. After the review of the current state of play and the discussion in GoodBrother, we may claim that the first solutions in this direction are starting to appear in the literature. A multidisciplinary debate among experts and stakeholders is paving the way towards AAL ensuring ergonomics, usability, acceptance and privacy preservation. The DIANA, PAAL, and VisuAAL projects are examples of this fresh approach. This report provides the reader with a review of the most recent advances in audio- and video-based monitoring technologies for AAL. It has been drafted as a collective effort of WG3 to supply an introduction to AAL, its evolution over time and its main functional and technological underpinnings. In this respect, the report contributes to the field with the outline of a new generation of ethical-aware AAL technologies and a proposal for a novel comprehensive taxonomy of AAL systems and applications. Moreover, the report allows non-technical readers to gather an overview of the main components of an AAL system and how these function and interact with the end-users. The report illustrates the state of the art of the most successful AAL applications and functions based on audio and video data, namely lifelogging and self-monitoring, remote monitoring of vital signs, emotional state recognition, food intake monitoring, activity and behaviour recognition, activity and personal assistance, gesture recognition, fall detection and prevention, mobility assessment and frailty recognition, and cognitive and motor rehabilitation. For these application scenarios, the report illustrates the state of play in terms of scientific advances, available products and research project. The open challenges are also highlighted. The report ends with an overview of the challenges, the hindrances and the opportunities posed by the uptake in real world settings of AAL technologies. In this respect, the report illustrates the current procedural and technological approaches to cope with acceptability, usability and trust in the AAL technology, by surveying strategies and approaches to co-design, to privacy preservation in video and audio data, to transparency and explainability in data processing, and to data transmission and communication. User acceptance and ethical considerations are also debated. Finally, the potentials coming from the silver economy are overviewed. (shrink)

This article explores the role of second-order anger in the formation of resistant feminist space through the work of María Lugones and Sara Ahmed. I argue that this incommunicative form of anger can operate as a bridge between two senses of resistant spatiality in Lugones, connecting the hangout, which is a collective and transgressive space for alternative sense making, and the cocoon, which is a solitary and germinative space of tense internal transformation. By weaving connections with Ahmed’s concept (...) of feminist fragile sheltering, I demonstrate that the insulating character of second-order anger need not be equated with spatial solitude. Rather, given its orientation toward a future becoming away from oppressed subjectivity, germinative cocooning can be understood as constitutive of collective, feminist, and resistant spaces. I conclude, therefore, that feminist spaces ought to shelter second-order angers and embrace fragility as a condition of resistant transformation. (shrink)

In response to our critics, we clarify and defend key ideas in the report Open and Inclusive: Fair Processes for Financing Universal Health Coverage. First, we argue that procedural fairness has greater value than Dan Hausman allows. Second, we argue that the Report aligns with John Kinuthia’s view that a knowledgeable public and a capable civil society, alongside good facilitation, are important for effective public deliberation. Moreover, we agree with Kinuthia that the Report’s framework for procedural fairness applies not merely (...) within the health sector, but also to the wider budget process. Third, we argue that while Dheepa Rajan and Benjamin Rouffy-Ly are right that robust processes for equal participation are often central to a fair process, sometimes improvements in other aspects of procedural fairness, such as transparency, can take priority over strengthening participation. Fourth, while we welcome Sara Bennett and Maria Merritt’s fascinating use of the Report’s principles of procedural fairness to assess the U.S. President’s Emergency Plan for AIDS Relief, we argue that their application of the Report’s principle of equality to development partners’ decision-making requires further justification. Education is a pillar of buen vivir, the guiding ideal of Ecuador’s 2008 Constitution. In this framework, Ecuador made significant shifts in its education system from 2006 to 2016, the decade of the Citizens’ Revolution. The key buen vivir concepts and processes that framed these shifts were considering education as a right, as a social debt, and as a driver of a more just, knowledge-intensive and clean economy. Resource allocation, general access, learning, and inclusion of structurally marginalized groups showed significant (...) improvement in this decade, along with other key political, economic and social changes, thus making significant advances in the emancipation of society toward buen vivir, and marking elements of how and why advancing this transformation is important. Este filósofo irlandés, católico, propone una cuarta reducción fenomenológica, esto es, volver al eschaton enraizado en la existencia cotidiana: encontrar la voz y el rostro de lo más alto en lo más bajo. This paper gives a framework for understanding causal counterpossibles, counterfactuals imbued with causal content whose antecedents appeal to metaphysically impossible worlds. Such statements are generated by omissive causal claims that appeal to metaphysically impossible events, such as “If the mathematician had not failed to prove that 2+2=5, the math textbooks would not have remained intact.” After providing an account of impossible omissions, the paper argues for three claims: (i) impossible omissions play a causal role in the actual world, (ii) causal (...) counterpossibles have broad applications in philosophy, and (iii) the truth of causal counterpossibles provides evidence for the nonvacuity of counterpossibles more generally. In "Changing the Past" (2010), Peter van Inwagen argues that a time traveler can change the past without paradox in a growing block universe. After erasing the portion of past existence that generates paradox, a new, non-paradox-generating block can be "grown" after the temporal relocation of the time traveler. -/- I articulate and explore the underlying mechanism of Van Inwagen's model: the time traveler's control over the location of the objective present. Van Inwagen's model is aimed at preventing paradox by (...) changing the past, but it achieves something broader than paradox avoidance: it gives tools for a new model of time travel. I use van Inwagen's tools to develop a new kind of time travel in which in which the location of the objective present is shifted by the time traveler. I call this type of time travel Movable Objective Present, or MOP. After defining MOP, I argue that it is compatible with any theory of time that accepts hypertime, including presentism and moving spotlight theory. (shrink)

Proponents of grounding often describe the notion as "metaphysical causation" involving determination and production relations similar to causation. This paper argues that the similarities between grounding and causation are merely superficial. I show that there are several sorts of causation that have no analogue in grounding; that the type of "bringing into existence" that both involve is extremely different; and that the synchronicity of ground and the diachronicity of causation make them too different to be explanatorily intertwined.

In this paper I present a novel taxonomy of envy, according to which there are four kinds of envy: emulative, inert, aggressive and spiteful envy. An inquiry into the varieties of envy is valuable not only to understand it as a psychological phenomenon, but also to shed light on the nature of its alleged viciousness. The first section introduces the intuition that there is more than one kind of envy, together with the anecdotal and linguistic evidence that supports it. The (...) second section proposes and explains in detail a definition of envy tout court. The third section presents a recurring distinction between behavioral tendencies of envy, which has been explained in two distinct ways, one mostly proposed by psychologists, the other discernible in the philosophical tradition. The fourth section argues that these models of explanation track two variables, whose interplay is responsible for the existence of the four envies. The fifth section illustrates four paradigmatic cases, and provides a detailed analysis of the phenomenology, motivational structure, and typical behavioral outputs of each. Indica algunos filósofos que han aceptado acríticamente dichos ataques a la ontoteología o concepción de Dios, y señala otros (Lévinas, Marion) que buscan vías de salida. Estas vías de salida son la fenomenología de la donación, entendiendo a Dios como fenómeno saturado que se da a un yo pasivo (no al yo constituyente moderno), donación que supera la visión representacional (...) de Dios y abre el camino a una hermenéutica de la donación. The debate on love's reasons ignores unrequited love, which—I argue—can be as genuine and as valuable as reciprocated love. I start by showing that the relationship view of love cannot account for either the reasons or the value of unrequited love. I then present the simple property view, an alternative to the relationship view that is beset with its own problems. In order to solve these problems, I present a more sophisticated version of the property view that integrates ideas from (...) different property theorists in the love literature. However, even this more sophisticated property view falls short in accounting for unrequited love's reasons. In response, I develop a new version of the property view that I call the experiential view. On this view, we love a person not only in virtue of properties shaped by and experienced in a reciprocal loving relationship, but also in virtue of perspectival properties, whose value can be properly assessed also outside of a reciprocal loving relationship. The experiential view is the only view that can account not only for reciprocated love's reasons, but also for unrequited love's reasons. (shrink)

El giro teológico de la fenomenología francesa contemporánea abre nuevos caminos de reflexión a la filosofía y a la teología, por la donación del fenómeno saturado.

Este trabajo tiene como objetivo mostrar lo que es una sana laicidad en la sociedad actual pluralista, multicultural, democrática y diversa. En primer lugar se presentan dos tentaciones de la iglesia hoy: refugiarse en el ghetto y cerrarse al mundo dando razón a los fundamentalistas laicos que la consideran como algo privado, o salir a la cruzada a imponer sus creencias y su mensaje. Luego se analiza el proceso histórico de formación del pluralismo, de la laicidad y de la libertad (...) religiosa con énfasis en los modelos norteamericano y francés. Se concluye con una visión de lo que es la laicidad en la doctrina de la iglesia católica hoy y una propuesta de lo que debe ser el verdadero pluralismo y la sana laicidad hoy. This article has as aim show what is a healthy secularism in the current pluralist, multicultural, democratic and diverse society. First, it presents two temptations of the church today: to shelter in the ghetto and to be closed to the world giving reason to the lay fundamentalists who consider faith to be something private, or to go out to the crusade to impose Christian beliefs and message. Then there is analyzed the historical process of formation of the pluralism, of the secularism and of the religious freedom emphatically in the models North American and French. The article concludes with a vision of what is the secularism in the doctrine of the catholic church today and a proposal of what must be the real pluralism and the healthy secularism today. Theories of causation grounded in counterfactual dependence face the problem of profligate omissions: numerous irrelevant omissions count as causes of an outcome. A recent purported solution to this problem is proportionality, which selects one omission among many candidates as the cause of an outcome. This paper argues that proportionality cannot solve the problem of profligate omissions for two reasons. First: the determinate/determinable relationship that holds between properties like aqua and blue does not hold between negative properties like not aqua and (...) not blue. Negative properties are those at stake in omissive causation. Second: proportionality misconstrues the nature of the problem to be solved. (shrink)

This paper argues that so-called “trumping preemption” is in fact overdetermination or early preemption, and is thus not a distinctive form of redundant causation. I draw a novel lesson from cases thought to be trumping: that the boundary between preemption and overdetermination should be reconsidered.

El Realismo Científico Estándar sostiene el enfoque metafísico de que el mundo es como es independiente de la mente. Sin embargo, el presente artículo demuestra cómo esta postura es incompatible con todas las teorías no-eliminativistas sobre la mente, lo cual hace que la postura sea inconsistente, incompatible con la ciencia, elimina la consciencia, la intencionalidad, la causación mental y la ética. Se propone una tesis realista alternativa que conserva la idea de que el mundo en general es de la forma (...) que es, independiente de lo que pensemos sobre él, compatible con la mente como parte real del mundo. Este cambio restaura la posibilidad de consistencia, la mente, la consciencia, la intencionalidad, la ciencia y la ética. -/- Standard Scientific Realism holds the metaphysical view that the world is the way it is independent of the mind. However, this paper demonstrates how this view is incompatible with all non-eliminativist theories of mind, leading it to be inconsistent, incompatible with science, and eliminating consciousness, intentionality, mental causation and ethics. An alternative realist thesis is proposed which preserves the idea that generally the world is the way it is independent of what we think of it, compatible with mind as a real part of the world. This reform restores the possibility of consistency, mind, consciousness, intentionality, science and ethics, while at the same time preserving the theoretical advantages over non-realist competitors. Debates over what is fundamental assume that what is most fundamental must be either a “top” level (roughly, the biggest or highest-level thing), or a “bottom” level (roughly, the smallest or lowest-level things). Here I sketch an alternative to top-ism and bottom-ism, the view that a middle level could be the most fundamental, and argue for its plausibility. I then suggest that the view satisfies the desiderata of asymmetry, irreflexivity, transitivity, and well-foundedness of fundamentality, that the view has explanatory power (...) on par with that of top-ism and bottom-ism, and that it satisfies the Principle of Sufficient Reason. This paper develops and articulates a metaphysics of intersectionality, the idea that multiple axes of social oppression cross-cut each other. Though intersectionality is often described through metaphor, theories of intersectionality can be formulated using the tools of contemporary analytic metaphysics. A central tenet of intersectionality theory, that intersectional identities are inseparable, can be framed in terms of explanatory unity. Further, intersectionality is best understood as metaphysical and explanatory priority of the intersectional category over its constituents, akin to metaphysical priority of (...) the whole over its parts. I present and develop the view that omissions are de re possibilities of actual events. Omissions do not literally fail to occur; rather, they possibly occur. An omission is a tripartite metaphysical entity composed of an actual event, a possible event, and a contextually specified counterpart relation between them. This view resolves ontological, causal, and semantic puzzles about omissions, and also accounts for important data about moral responsibility for outcomes resulting from omissions.

This paper suggests the democratic direction in which the right of freedom of expression should be conceived and applied. In the first two sections it suggests some counter-examples to, and diagnoses of, the libertarian and liberal conceptions of freedom of expression, taking Scanlon (1972) and Scanlon (1979), respectively, to be their chief proponents. The paper suggests that these conceptions cannot take into account clear examples, like fraudulent propaganda, which should not be legal. The democratic conception takes it to heart that (...) the pillars upon which the right of freedom of expression is founded are individual and collective autonomy, the right to know facts of public interest and information necessary for effective democratic control of government. The paper suggests that in a time when private powers seriously threaten these pillars, it is correct for the government to step in to provide the framework in which genuine discussion geared toward fulfilling the objectives of these pillars can take place. This essay confronts Ray Brassier’s vindication of nihilism with other two important but frequently underexamined philosophical attempts to overcome nihilism: Hans Jonas’ and Keiji Nishitani’s. By putting these different takes on nihilism into dialogue, it explores some blind spots in Brassier’s position, as well as some of the practical consequences, for our current planetary situation, of undertaking a radical divorce between the normative and the natural that results from his radical nihilism. The article opts for a more moderate acceptance and (...) eventual self-overcoming of nihilism, according to which, even if natural entities are indifferent to human reasons and meanings, this does not entail that nature is bereft of a human-independent normative dimension. In other words, the essay argues that care must be taken not to confuse criticisms of an anthropocentric conception of reasons and meanings with the belief that meaning is completely absent from the natural world. Thus, the central contention of the article is that, given our current climate and ecological catastrophe, one of the most pressing tasks of contemporary philosophy is to understand normativity in non-anthropocentric ways, so that humans are no longer considered as the only entities that respond to normativity. Such an attitude conceives humans as estranged normative creatures amidst a meaningless, indifferent natural world, toward which they would have no ethical responsibilities. The essay finishes by suggesting ways in which to develop an account that does not fall into this ethical vacuum. (shrink)

Se hace presente la necesidad de una ontología relacional para la teología (Hemmerle, 1996, p. 26) y la fenomenología actual ayuda a dar piso a esa ontología en cuanto muestra el fondo de la existencia, de la realidad, de la forma de aquello que está en el origen como dato dado. La donación se convierte así en la nueva concepción del ser, no el ser como esse, sino como donación y relación, como llamado originario y como respuesta existencial, así se (...) puede pensar una ontología trinitaria cristiana pero también plenamente humana. La pandemia del Covid19 es un acontecimiento entendido en la forma fenomenológica de su llegada y de su permanencia, pues irrumpe, cambia, afecta a la humanidad en su totalidad. No es un acontecimiento personal o territorial que se convierte en objeto de alguna disciplina en especial o responsabilidad de ciertos actores sociales. Más allá de la búsqueda de su origen o de las causas de su aparición, hay en ella una característica revelatoria que convoca, llama y pide una respuesta. Escuchar (...) la llamada y dar el responsorio es tarea obligada de la humanidad actual por encima de visiones sesgadas, parciales, culpabilizantes o escapistas. La enseñanza social de la Iglesia aporta, en este momento, una visión integral para afrontar el momento difícil mediante la acción y agencia de todos los seres humanos. La propuesta es una ética ecológica integral que reconozca la interconexión entre toda la realidad y proponga una acción de cuidado integral de la creación. (shrink)

Es difícil imaginar una sociedad del buen vivir sin arte. Por ello, la creatividad artística es reconocida como derecho en la Constitución del Ecuador, y como derecho humano en los intrumentos internacionales relevantes. Partiendo de esta reflexión, los artículos de este libro argumentan que siendo el arte un derecho, le corresponde al Estado la provisión de condiciones para su garantía por medio de políticas públicas, que deben tomar en cuenta tanto las especificidades de las personas, y los pueblos y nacionalidades, (...) como el contexto tecnológico de la era digital, que brinda las bases para una sociedad abierta donde el conocimiento sea libre. Detractors of Searle’s Chinese Room Argument have arrived at a virtual consensus that the mental properties of the Man performing the computations stipulated by the argument are irrelevant to whether computational cognitive science is true. This paper challenges this virtual consensus to argue for the first of the two main theses of the persons reply, namely, that the mental properties of the Man are what matter. It does this by challenging many of the arguments and conceptions put forth by the (...) systems and logical replies to the Chinese Room, either reducing them to absurdity or showing how they lead, on the contrary, to conclusions the persons reply endorses. The paper bases its position on the Chinese Room Argument on additional philosophical considerations, the foundations of the theory of computation, and theoretical and experimental psychology. First, several contributors argue that the experience of pregnancy, when analyzed by phenomenological tools, undermines several distinctions that are central to Western philosophy, most importantly the subject-object distinction and the self-other and own-alien distinctions. This line of argument was already outlined by Iris Marion Young in her influential essay (...) “Pregnant Embodiment: Subjectivity and Alienation” (1984). The other dominant argument is related to the first one, and it states that organic birth is the event that establishes the first experiential separation between the self and the other. On this understanding, the mother-fetus relation would not involve any relations between two corporeal selves; all such relations would be postnatal. This notion has been defended, for example, by Christine Schües (1997; 2000) and Johanna Oksala (2003).1On the other hand, classical phenomenology is dominated by the idea that the rigorous first-person methodology that is essential to phenomenology dictates that the sense of birth must be studied primarily by reflection on the structures of our own recollection or memory. Consequently, the primary sense of human birth would be that of an unattainable limit. This is argued on the basis of the existential fact that we all are born but cannot recall our own birth, or else on the basis of the transcendental fact that the structure [End Page 31] of retention ties each living present to an earlier one and implies that the transcendental ego cannot be subject to generation.2 From this perspective, all analyses and reflections of the experiences of labor, gestation, and pregnancy would be secondary since the sense of birth that these experiences involve is the nativity of another human being and not the nativity of the reflecting self.This paper challenges both the feminist and the classical phenomenological approach. I maintain that careful phenomenological analyses of the experience of pregnancy undermine both notions. Such analyses show, on the one hand, that pregnancy does not imply a nondistinction or self-other fusion but on the contrary involves a specific self-other divide. At the same time, they demonstrate that the sense of birth is more complex than the classical recollection-paradigm suggests and that it includes more components than the signification of an unattainable limit. A proper phenomenology of birth must take into account not only the universal fact that we all are born, but also the equally universal fact that each of us is born from another human being, that is, some other human subject.3 This other human being who “gave” us birth or “from whose flesh we were born” provides us with a unique perspective on our own past, beyond the limits of our own recollection. Her perspective is incomparable to any other external perspective; rather than simply giving us an additional third-person viewpoint on our own organic birth, this one person is able to open a second-person perspective on our pre- and postnatal life and the transition between them—all of which is beyond our own recollection.My argument proceeds by the following steps:First, I develop a fresh discourse on the experience of pregnancy, by studying a set of remarks to be found in Julia Kristeva’s postphenomenological discourse on maternity, on the one hand, and in Simone de Beauvoir’s existential-phenomenological discourse on feminine embodiment, on the other hand. I use these remarks as leading clues for a novel phenomenological study of the experience of pregnancy.4 Contra Young’s influential account mentioned above, I argue that gestation, as experienced by women who live it in the first person, includes a separation between two sensory-motor beings in a nesting relation: the pregnant self and the embryonic other. It is a question of identifying the theoretical foundations that precede the encyclical Laudato Si’ (ls) from philosophy and theology: the harmony of quaternity, the mystique of creation, the science-faith dialogue and the theology of the small and the poor. This paper is a follow-up of the first part of the persons reply to the Chinese Room Argument. The first part claims that the mental properties of the person appearing in that argument are what matter to whether computational cognitive science is true. This paper tries to discern what those mental properties are by applying a series of hypothetical psychological and strengthened Turing tests to the person, and argues that the results support the thesis that the Man performing the computations (...) characteristic of understanding Chinese actually understands Chinese. The supposition that the Man does not understand Chinese has gone virtually unquestioned in this foundational debate. The persons reply acknowledges the intuitive power behind that supposition, but knows that brute intuitions are not epistemically sacrosanct. Like many intuitions humans have had, and later deposed, this intuition does not withstand experimental scrutiny. The second part of the persons reply consequently holds that computational cognitive science is confirmed by the Chinese Room thought experiment. (shrink)

Should you take a pill that gives you all the health benefits of sleep and allows you to stay awake? I argue that you shouldn’t. I propose three reasons why sleeping, conceived of as a socially and culturally embedded human activity, is valuable. First, there is aesthetic value in the rituals that typically precede sleeping; second, there is interpersonal value in the intimacy that stems from sleeping with other people; third, there is ethical value in mere presence and in retreating (...) from consciousness. In order to fully support my argument, I situate it within a conception of goodness that embraces the fragility of the human condition and the limitations stemming from our corporeal nature. I argue for the view that envy and jealousy are distinct emotions, whose crucial difference is that envy involves a perception of lack while jealousy involves a perception of loss. I start by noting the common practice of using ‘envy’ and ‘jealousy’ almost interchangeably, and I contrast it with the empirical evidence that shows that envy and jealousy are distinct, albeit similar and often co-occurring, emotions. I then argue in favor of a specific way of understanding their distinction: the view (...) that envy is a response to a perceived lack of a valuable object, while jealousy is a response to a perceived loss of a valuable object. I compare such a view with the most compelling alternative theories, and show that it accounts better for paradigmatic cases. I conclude by showing how the lack vs. loss model can handle complications: ambiguous cases, that is, when it is epistemically unclear whether one experiences lack or loss; hybrid cases, that is, when one seems to experience both lack and loss; and borderline cases, that is, when it is metaphysically unclear whether one experiences lack or loss. The thesis develops solutions to two main problems for mental realism. Mental realism is the theory that mental properties, events, and objects exist, with their own set of characters and causal powers. The first problem comes from the philosophy of science, where Psillos proposes a notion of scientific realism that contradicts mental realism, and consequently, if one is to be a scientific realist in the way Psillos recommends, one must reject mental realism. I propose adaptations to the conception of scientific (...) realism to make it compatible with mental realism. In the process, the thesis defends computational cognitive science from a compelling argument Searle can be seen to endorse but has not put forth in an organized logical manner. A new conception of scientific realism emerges out of this inquiry, integrating the mental into the rest of nature. The second problem for mental realism arises out of non-reductive physicalism- the view that higher-level properties, and in particular mental properties, are irreducible, physically realized, and that physical properties are sufficient non-overdetermining causes of any effect. Kim’s Problem of Causal Exclusion aims to show that the mental, if unreduced, does no causal work. Consequently, given that we should not believe in the existence of properties that do not participate in causation, we would be forced to drop mental realism. A solution is needed. The thesis examines various positions relevant to the debate. Several doctrines of physicalism are explored, rejected, and one is proposed; the thesis shows the way in which Kim’s reductionist position has been constantly inconsistent throughout the years of debate; the thesis argues that trope theory does not compete with a universalist conception of properties to provide a solution; and shows weakness in the Macdonald’s non-reductive monist position and Pereboom’s constitutional coincidence account of mental causation. The thesis suggests that either the premises of Kim’s argument are consistent, and consequently his reductio is logically invalid, or at least one of the premises is false, and therefore the argument is not sound. Consequently, the Problem of Causal Exclusion that Kim claims emerges out of non-reductive physicalism does not force us to reject mental realism. Mental realism lives on. (shrink)

In this paper, I ask whether there is a defensible philosophical view according to which everybody is beautiful. I review two purely aesthetical versions of this claim. The No Standards View claims that everybody is maximally and equally beautiful. The Multiple Standards View encourages us to widen our standards of beauty. I argue that both approaches are problematic. The former fails to be aspirational and empowering, while the latter fails to be sufficiently inclusive. I conclude by presenting a hybrid ethical–aesthetical (...) view according to which everybody is beautiful in the sense that everybody can be perceived through a loving gaze. I show that this view is inclusive, aspirational and empowering, and authentically aesthetical. (shrink)

This paper poses an original puzzle about the relationship between causation and moral responsibility called The Moral Difference Puzzle. Using the puzzle, the paper argues for three related ideas: (1) the existence of a new sort of moral luck; (2) an intractable conflict between the causal concepts used in moral assessment; and (3) inability of leading theories of causation to capture the sorts of causal differences that matter for moral evaluation of agents’ causal contributions to outcomes.

I argue that fitting envy plays a special role in safeguarding our happiness and flourishing. After presenting my theory of envy and its fittingness conditions, I contrast Kant’s view that envy is always unfitting with D’Arms and Jacobson’s defense of fitting envy as an evolutionarily-shaped response to a deep and wide human concern, that is, relative positioning. However, D’Arms and Jacobson don’t go far enough. First, I expand on their analysis of positional goodness, distinguishing between an epistemic claim, according to (...) which we use implicit or explicit comparison to know what position we occupy in a continuum of goodness, and thus to form judgments of goodness, and a metaphysical one, according to which much human goodness depends on implicit or explicit rankings and positionality. Second, I argue that fitting envy is not only intrinsically valuable qua fitting response to authentic goodness, but can be epistemically, morally and prudentially valuable. (shrink)

Widespread causal overdetermination is often levied as an objection to nonreductive theories of minds and objects. In response, nonreductive metaphysicians have argued that the type of overdetermination generated by their theories is different from the sorts of coincidental cases involving multiple rock-throwers, and thus not problematic. This paper pushes back. I argue that attention to differences between types of overdetermination discharges very few explanatory burdens, and that overdetermination is a bigger problem for the nonreductive metaphysician than previously thought.

Suppose that Billy and Suzy each throw a rock at window, and either rock is sufficient to shatter the window. While some consider this a paradigmatic case of causal overdetermination, in which multiple cases are sufficient for an outcome, others consider it a case of joint causation, in which multiple causes are necessary to bring about an effect. Some hold that every case of overdetermination is a case of joint causation underdescribed: at a maximal level of description, every cause is (...) necessary to bring about the outcome in precisely the way that it occurs. -/- This paper shows the latter principle to be false. I introduce a novel class of events that are insensitive to the additive force of multiple causes. They are to be contrasted with sensitive events, which physically and counterfactually vary according to the number and sorts of causes they have. I argue that sensitive effects are symptoms of joint causation; insensitive effects are symptoms of overdetermination. Insensitive effects resulting from multiple causes cannot be classified as "joint causation underdescribed," but only as overdetermination. -/- I suggest that cases of "trumping preemption" should be understood as cases of overdetermination with insensitive effects. Consequently, Lewis' influence account of causation cannot handle these cases. (shrink)

Auty (1993) and Sachs and Warner (1997) reignited the line of argument of the resource curse: the idea that natural resource wealth has negative net effects on the development of nations. However, the result has been found to be highly dependent on the types of variables used to represent natural resource wealth (Brunnschweiler, 2007) and similar questions can raised about variables used to represent being “cursed”. In this paper we pursue the hunt for better variables by looking at the relationship (...) between average income from natural resources per person and a wide array of key development indicators: Adjusted National Net Income, GDP per capita, an aggregate of services and industrialized goods, inequality measured by the Gini index, Poverty, the Human Development Index, the Prosperity Index, the Social Progress Index and the Fragile State Index. We do this on a global scale between 1970 and 2010. On the contrary, we find that natural resource wealth is positively linked to development. We suggest, alternatively, that much of the actual cases where abundant natural resources hurt nations have been cases of common theft by tyrants, often backed by imperial powers. (shrink)

There has been a long history of tension between feminists and feminist philosophy, on the one hand, and logic, on the other hand. This tension expresses itself in many ways, including claims that logic is a tool of the patriarchy, that logic/rationality/analytical tools in philosophy need to be rejected if women are to fully participate, that women = body and man = mind, that to do feminist philosophy one must do it as a situated, embodied person, not as an impersonal, (...) disembodied mind, that logic is “a masculine subject”. However the tension is expressed, it is women in logic and women logicians who are caught in between. The goal of my paper is to explore a conception of logic that not only is not inconsistent with being a feminist, but is actively welcoming of women as logicians. (shrink)

In juxtaposition with the myth and tragedy of Ovid’s Medea, this paper investigates the possibility within the Kantian conception of agency of understanding moral evil as acting against one’s better judgment. It defends the thesis that in Kant self-deception, i. e. the intentional untruthfulness to oneself, provides the fundamental structure for choosing against the moral law. I argue that, as Kant’s thought progresses, self-deception slowly proceeds to become the paradigmatic case of moral evil. This is discussed with regard to two (...) important topics in his later moral philosophy: the doctrine of radical evil and the crucial role of the duty of truthfulness in ethics. The inquiry into Kant’s theory of conscience unfolds both against this theoretical background and in light of its historical roots in the polemic against casuistry and probabilism. This contribution closes with a brief look at the tools Kant implements to counter this tendency to self-deception in moral judgment and particularly at the role casuistry plays within his conception of moral education.
